Dear Arizona Senators Sinema and Kelly,

On September 24, 2021, we submitted a Freedom of Information Request along with the WATER PROTECTOR LEGAL COLLECTIVE requesting disclosure of records related to the case of the Forced Disappearance of the 43 Ayotzinapa students on September 26, 2014, in Iguala Guerrero, Mexico.

On May 24, 2021, Mexican President Andres Manuel Lopez Obrador communicated he had received files from the United States regarding the investigation of the 2014 Ayotzinapa disappearances and subsequent criminal coverup by officials of the Mexican government. President Lopez Obrador received these files after a virtual meeting with Vice President Kamala Harris on May 7, 2021.  

The TONATIERRA Human Rights Commission has accompanied the parents and families of the 43 Ayotzinapa students for over seven years now in their attempts to bring accountability and justice to the case.

 

Although we have sent this message to both of your offices on December 26, 2021, via the email address provided on your website and the message has been confirmed to have been received, we have not had any substantive response from either of you regarding our request for assistance in terms of bringing to light the relevant information as outlined our initial FOI request.

 

We shall continue to follow up with your offices to arrange for a meeting to discuss the particulars of the human rights issues involved.

Phoenix, Arizona – Today a Freedom of Information Act request was formally submitted to the Biden Administration by TONATIERRA and the WATER PROTECTOR LEGAL COLLECTIVE soliciting disclosure of the files related to the US government’s investigation into the Forced Disappearance of the 43 students from Ayotzinapa Rural Teachers’ College missing since September 26, 2014.

Estimados Senadores Sinema y Kelly,

 

El 24 de septiembre de 2021 presentamos una Solicitud de Libertad de Información (FOI) junto con el COLECTIVO LEGAL PROTECTOR DEL AGUA solicitando la divulgación de antecedentes relacionados con el caso de la Desaparición Forzada de los 43 estudiantes de Ayotzinapa el 26 de septiembre de 2014, en Iguala Guerrero, México.

El 24 de mayo de 2021, el presidente mexicano, Andrés Manuel López Obrador, comunicó que había recibido archivos de Estados Unidos sobre la investigación de las desapariciones de Ayotzinapa en 2014 y el subsiguiente encubrimiento criminal por parte de funcionarios del gobierno mexicano. El presidente López Obrador recibió estos archivos luego de una reunión virtual con la Vicepresidenta Kamala Harris el 7 de mayo de 2021.

La Comisión de Derechos Humanos de TONATIERRA ha acompañado a los padres y familiares de los 43 estudiantes de Ayotzinapa desde hace más de siete años en su intento de llevar la rendición de cuentas y la justicia al caso.

Aunque enviamos este mensaje a sus dos oficinas el 26 de diciembre de 2021, a través de la dirección de correo electrónico proporcionada en su sitio web y se confirmó que se recibió el mensaje, no hemos recibido ninguna respuesta sustancial de ninguno de ustedes con respecto a nuestra solicitud por asistencia en términos de sacar a la luz la información relevante como se describe en nuestra solicitud inicial de FOI.

Haremos un seguimiento con sus oficinas para organizar una reunión para discutir los detalles de los problemas de derechos humanos involucrados.

On September 26, 2014 in the town of Iguala, Guerrero in Mexico, 43 students from the rural teacher preparation school of Ayotzinapa were Forcibly Disappeared by federal and local police agents of the Mexican state.  Six others were killed that night, including three students and three innocent bystanders shot and killed when the Mexican army attacked the bus the students were taking to Mexico City.

The 43 Ayotzinapa students were unarmed, they were on their way to participate in the commemoration of the massacre of the students in Tlaltelolco Square in 1968. Unknown to the students, was the fact that the bus they were on was also carrying a contraband load of heroin for delivery to the US, in Atlanta and Chicago.

 

The military and police agents were sent by the cartels of the narco-state in Mexico to recover the heroin, at any cost.

Now, over eight years later, the parents, families, and the community of the Ayotzinapa continue to demand accountability and justice not only for the 43 Ayotzinapa students, but also for the tens of thousands of victims of killed and disappeared in Mexico under the shroud of the US backed “War on Drugs” and the US financed Plan Merida Mexico.

Today, the guilty parties to the crime of the Forced Disappearance of the 43 Ayotzinapa students remain at large. In open collusion and complicity, the highest echelon of the Narco State in Mexico, the guilty parties who were facing formal court charges in Mexico and in the US, have escaped capture and detention, and after fleeing to Canada, are living in comfort with protection and political exile in Israel.

“Repudiar no es Revocar; Restauración no Reparación”

Esta mañana, tuve que llamar a mi prima y decirle que dejara de hacer el Snoopy Happy Dance. Estaba bailando de alegría porque habíamos oído que el Papa había revocado las Doctrinas del Descubrimiento. Eso no era cierto. El Papa solo "repudió" las Doctrinas del Descubrimiento, no las "revocó". Luego llamó otro primo y tuve que decirle lo mismo. Hay una diferencia entre 'repudiar' y 'revocar'.

La palabra “repudiar” según el Diccionario Miriam-Webster significa “desecharse” o “rehusarse a tener algo que ver con” o “rehusarse a reconocer”. Todos podemos hacer eso con esas Doctrinas atroces, horribles, abominables, espantosas y repugnantes que fueron establecidas por la Iglesia Católica.

El hecho de que estas Doctrinas políticas surgieran a fines del siglo XV no es una excusa, ya que estas doctrinas son la base legal sobre la que se sustentan las leyes estadounidenses y canadienses en la actualidad. Recientemente, en 2005, la difunta jueza de la Corte Suprema Ruth Bader Ginsberg usó estas Doctrinas contra los Oneidas en Sherrill v. Oneida Indian Nation en Nueva York.

Estas Doctrinas todavía tienen un efecto sobre nosotros hoy. Esto ni siquiera comienza a cubrir el genocidio de naciones (plural) en las Américas, África y el Pacífico. La tortura y el sufrimiento soportados durante estos cientos de años se transmiten a nuestros genes como metilatos del trauma. Las naciones colonizadoras, como los EE. UU., continúan haciendo lo que pueden sin tener en cuenta los derechos humanos y civiles de los pueblos indígenas. Después de todo, lo único que buscan son los recursos.

La palabra “revocar”, también según el Diccionario, significa “anular por revocación o retirada” o “derogar” o “rescindir”. El Papa tiene esa capacidad, que el resto de nosotros no tenemos. La Iglesia Católica necesita ‘revocar’ las Doctrinas del Descubrimiento. Necesita derogarlos ya que todo el mundo ahora sabe que los pueblos indígenas de todo el mundo son, de hecho, seres humanos. Aunque en los Estados Unidos, no somos “seres humanos” a menos que denunciemos a nuestras propias Naciones Indígenas, y nos expatriemos según el caso Standing Bear. Pero eso es para otra discusión.

La pregunta es "¿Por qué el Papa haría esto ahora?" ¿Muchos representantes indígenas le han estado pidiendo que haga esto durante décadas? Entonces, ¿por qué haría esto ahora?

Luego recordé haber enviado recientemente una respuesta al Relator Especial de las Naciones Unidas sobre la Promoción de la Verdad, la Justicia y la Reparación, Fabian Salvioli, quien solicitó Aportes sobre la cuestión del financiamiento de las reparaciones adeudadas a las víctimas de graves violaciones de los derechos humanos. Y también recordé haber visto artículos sobre la Iglesia Católica y las reparaciones principalmente de los descendientes de esclavos sacados de África.

Entonces supe por qué el Papa y la Iglesia Católica están haciendo esto ahora. No tiene que ver con los pueblos indígenas como seres humanos sino con cuánto financiamiento se va a pedir.

No puede haber reparación por el genocidio de todas las naciones indígenas que ya no están presentes. ¿Cómo se paga financieramente por una vida humana? ¿No es eso de lo que se trata la esclavitud? ¿No es de eso de lo que se trata la trata de personas?

Recuerde, el Vaticano es una estado-nación. En el actual entendimiento político internacional es un Estado con reconocimiento internacional, y el Vaticano tiene un asiento en la Asamblea General de las Naciones Unidas como miembro sin derecho a voto.

¿El Vaticano ha planteado esta pregunta en la Asamblea General sobre el financiamiento de las violaciones de los derechos humanos de la esclavitud y el trato a los pueblos indígenas por causa de la colonización de los siglos?

Hay una diferencia entre “reparaciones” y “restauración”. En la situación de la nación Sioux es simple. Debe haber Restauración.

¿Cómo? El camino es sencillo. Hacer cumplir el Tratado completo de Fort Laramie de 1868, el último tratado legal realizado entre la Nación Sioux y los Estados Unidos. En particular es el Artículo II que establece que el territorio nombrado en el Tratado es “...separado para el uso y ocupación absoluta e imperturbable de los indios...” ¿Y quién puede hacer esto?

El proceso ya está allí con el Comité de Descolonización de la ONU. Sí, llevará tiempo. Sí, se necesitará dinero. Pero el camino ya ha sido probado con otras naciones indígenas como Timor Oriental.

Entonces, ¿ es que el Papa Francisco está diciendo “Repudiar” las Doctrinas del Descubrimiento ahora, mientras gana tiempo para poder decir “Revocar” las Doctrinas del Descubrimiento después de que el Relator Especial sobre la Verdad, ¿etc. entregue su informe a la Asamblea General de la ONU el próximo otoño de 2023?

En este momento, en lo que respecta a las reparaciones, la Iglesia Católica lo está delegando a regiones o áreas de manera individual.

Este informe se presenta de conformidad con el artículo 1 del Pacto Internacional de Derechos Civiles y Políticos (PIDCP), luego de la próxima revisión de los Estados Unidos por parte del Comité de Derechos Humanos y el Cuarto Informe Periódico de los Estados Unidos bajo el PIDCP.

Este informe explica por qué Estados Unidos nunca realizo la compra de Alaska ni tiene el derecho de usar el poder plenario domestico para llevar a cabo la supuesta y continua dominación de Alaska.

También escribo este informe para solicitar que el Comité recomiende que se reincorpore a Alaska a la lista de descolonización para facilitar el inicio del proceso de descolonización en Alaska como se pretendía originalmente en virtud del Artículo 73 de la Carta de las Naciones Unidas.

Que la Bula Papal Inter Caetera de Papa Alejando Sexto 1493 es NULLIFICADO, también igual cualquier Doctrina de Descubrimiento procedente que pretende deformar la relación de Armonía, Justicia, y la Paz de Nuestros Pueblos Indígenas de la Humanidad entera.

"The loggers of San Juan ask for bread and they don’t get it, they ask for cheese, they give them bones and cut their necks," my great grandma sang this rhyme to us before we fell asleep. The Loggers of St. John has several variations, but the background remains the same.  It is a lullaby to prepare children for what awaits rebels in this world. 

In some cases, instead of bread they give them wine, as happened in the old company stores. Instead of paying them with food or money they paid them with wine to get them drunk, indebted, and tied to the hacienda owner.  In other cases, it refers to workers in sawmills requesting better wages. As the rhyme says, instead of bread and cheese they end up cutting their necks.

 

We found it funny when my grandmother sang the rhyme to us, without realizing at that tender age, that they were preparing us for life. It was a lesson disguised as a nursery rhyme.   A lesson that continues in the different struggles in which we have been involved,  whether it is the fight for immigration reform, the  fight against the abuses of Sheriff Arpaio, the struggle of the Macehualli day laborers, and now the struggle of  "trailas" (Mobile Home Parks) residents.

The theme is the same as the lullaby that my great grandmother sang to us. 

Today it is close to one year that we requested that families not be evicted from  their mobile  homes.  We asked the owners, we asked  the state authorities, we asked the city council of Phoenix Arizona.  Yet, the same thing happened to us that happened to the loggers of San Juan, they gave us cheese in the form of vouchers to pay rent when before we had a home, in the case of Grand Canyon University they offered us 5,000 USD for our house in which we had lived 30 years.  

Now under a state law they offer us about the same for giving up our homes to millionaire companies.  In other words, they give us a bone and if we do not accept it, they cut our throats by sending the sheriffs to throw us out "without our belongings " into the street.

 

The bad thing is that the children of the "trailas"  are not listening to the song sung  by their grandmother. They are living the terror sung by corporations in their own flesh.   Worst of all, they are not asking for bread,  they are asking for more time to be able to find a home in a market that does not exist for them. 

How many of them will be able to find a home when the houses are worth between 350,000 and  500,000 USD? How many of them will be able to find a rental location when rents are between 1,500 and 3,000 USD?

 

Meanwhile in a final attempt by 3 council members, Carlos García, Betty Guardado, and Laura Pastor, by the time this column comes out, we will know if they achieved the  5 votes necessary to extend the time 6 months for those families who still cannot find a home to go to.   Frankly, I find it very difficult. Mayor Kate Gallego is  committed to big business and simply ignores it, when they evict hundreds of families. 

The trouble is that it is not only Kate Gallego, but also most of the Council and the staff behind them. They hide behind the sanctity of private property and their skewed interpretations of the  law to justify human rights violations against those affected.  The right to shelter has been a human right from the time we lived in caves until today. In the same way as the cradle song of my great-great-grandparents, they continue to give us bones and cut our throats in the name of progress.
